TERMS AND CONDITIONS FOR ORDERS PLACED
VIA THE BAMBINODIRECT WEBSITE OR BY TELEPHONE
These are the Terms and Conditions of sale of Bambino Direct. These terms
will apply to all purchases of goods when
you order via our website (www.bambinodirect.co.uk) or by telephone
using our Customer Services team. Any orders placed are strictly in
accordance with these terms & conditions you agree to be bound by.
1. DEFINITIONS & INTERPRETATIONS
In these conditions:
1.1 “Customer” means a person acting as a consumer who is purchasing
goods;
1.2 “You” means the customer submitting and order for goods;
1.3 “Goods” means the goods to be supplied under these conditions;
1.4 “Party” means either you or us “Parties” means you and us
1.5 “Writing” means letter, fax or email
2. ORDER PROCESS
2.1 The contract for supply of goods (“Contract”) will be formed when we
accept your order. Acceptance of an order for goods by us can only be
made in writing. All orders are subject to availability.
2.2 In order to counter internet fraud payments via our website will be
managed online with the banking organisations concerned through the
facilities offered by PROTX. This company is responsible for holding an
automated handling in a secure environment the information relating to
each order including card details. All orders are security checked to
prevent any fraudulent transactions and on occasions you may be asked
extra security questions prior to goods being dispatched.
2.3 We take reasonable care in ensuring that all material contained in
our website is accurate and up to date at the time it is posted. None of
the information on our website is to be relied upon as a statement or
representation of fact. All images, illustrations and descriptions are
for information only.
2.4 When placing an order for the first time you will be required to
register with us.
2.5 Before you submit your order you will be given the opportunity to
review your selection, check the total price of your order and correct
any input errors. We will acknowledge receipt of your order by sending a
confirmation email.
2.6 The sale will only be binding on us once we have notified you that
the goods have been dispatched. This means that if goods are shown on
our website but are not available or are incorrectly priced or otherwise
incorrectly described we shall not be obliged to sell you such goods.
3. PRICE & PAYMENT
3.1 The price of goods you order will be notified to you by telephone
before you place your order or shown on the website before you confirm
your order. All prices are in £ sterling and inclusive of VAT.
3.2 Your card will be debited at the time your order is placed. In the
event that the sum due from you cannot be debited for whatever reason
the sale will be cancelled immediately.
3.3 If an error is found in the price of goods you have ordered within 5 days we will
inform you as soon as possible and offer you the option of reconfirming
your order at the correct price or cancelling your order. If you cancel
we will refund or re-credit you for any sum that has been paid by you or
debited from your card for the goods.
4. CANCELLATION
4.1 You have the right to cancel your order by completing an online return form RMA.
If you exercise your right of cancellation after the goods have been
dispatched or delivered to the delivery address you will be responsible
for returning the goods to us as soon as possible with full order and id
details at your own cost to: RETURNS, BAMBINO DIRECT, UNIT A, TRIDENT BUSINESS PARK,
NEPTUNE WAY, LEEDS ROAD, HUDDERSFIELD, HD2 1UA.
Goods returned will be refunded
less our shipping costs. It is your responsibility to obtain proof
that the goods have been returned to us (royal mail signed for or parcel
force is recommended which gives proof of date of postage and delivery
tracking information).
4.2 Once an order
has been placed for Boori, Babystyle, King Parrott, Bebe-Jou, Lollipop
Lane, Izziwotnot or Tutti Bambini furniture the deposit will be non
refundable.
5. DELIVERY
5.1 The goods you order will be delivered between 9am-6pm only to the
address which you provide when you place your order. Delivery will be
made by UKMAIL, an email and SMS text message is sent at point of
dispatch confirming the consignment tracking number. You may track the
status of your delivery on www.ukmail.biz.
Delivery times are between 9am-6pm Monday to Friday. (Unfortunately deliveries to Europe
use other couriers and cannot be tracked through this link.)
5.2 You must inform us in writing of any shortages/damages to items
received within 24 hours of receiving the goods. (Note: for overseas deliveries
(excluding Ireland), no insurance for damage or loss is provided for goods once they leave the UK)
5.3 All deliveries must be signed for. UKMail will make 2 attempts to deliver your
order if there is no one at the address given to accept delivery of the
goods you will be carded requesting contact is made with the depot
holding your goods to arrange an alternative delivery date or to collect
goods from the depot. If no contact is made with the depot goods are
automatically returned back to us and we will charge £18.00 for
re-delivery. If at this point you refuse delivery or wish to cancel your
order £18.00 will be deducted from the refund due. (Note: European deliveries
use different couriers. Due to the process of deliveries through mainland Europe,
failed deliveries to regions outside of the UK (excluding Ireland) caused by
incorrectly supplied address details, or as a result of no one being able to
accept the goods, will receive no refund for failed deliveries until the
goods are returned intact to the Bambino Direct Warehouse.)
5.4 No delivery will take place unless payment for the goods has been
received. Every effort will be made to deliver the goods as soon as
possible after your order has been accepted. Any delivery date or time
specified by us is an estimate only and we will not be liable for any
loss or damage suffered by you through any reasonable or unavoidable
delay in delivery. Under the distance selling regulations set by the OFT
we will aim to deliver the goods within 30 days.
5.5 Ownership of the goods and the risk for damage to the goods pass to
you upon delivery. We shall repair or replace free of charge any goods
damaged in transit where delivery has been made by our carrier provided
that you give us written notification of such damage within 24 hours of
the delivery date. Goods are independently inspected before a
exchange/refund can be offered this procedure can take up to 20 days.
5.6 We cannot accept liability for any delays in delivery that are
beyond our control. We will not be liable to you by way of
representation for any losses which are not reasonably foreseeable by
both parties when the contract is formed arising in connection with the
supply of goods and related services or their use by you.
5.7 Delivery for the following brands of furniture can take between 3-6
weeks from date of ordering; Boori, Babystyle, King Parrott, Bebe-Jou,
Kidsmill, Lollipop Lane, Izziwotnot and Tutti Bambini. The respective
company will contact you to organise a suitable delivery and assembly
date (if assembly is applicable) Please note the deposit is non
refundable on these orders if cancelled.
5.8 For all orders for delivery outside of mainland UK, Northern Ireland, the Channel Islands and the Isle of Man. You acknowledge and agree that it is your responsibility to arrange for a courier to deliver the goods to you, or alternatively to collect the goods yourself from our premises. The seller is willing on your invitation and as your agent to instruct Parcelforce to deliver the relevant goods on your behalf for the prices set out in our delivery section. If you take up this option, you will enter into a direct contract with Parcelforce in respect of the delivery of the goods under their standard terms and not with the seller, and you will be liable to Parcelforce to pay the Delivery Rate. The seller will (unless you instruct us otherwise) collect payment of the Delivery Rate from you, and as your agent pay such amount to Parcelforce. Any liability in connection with such delivery shall be between Parcelforce and you, and shall not involve the seller. Insurance against loss or damage isn’t provided. The customer should arrange their own insurance against loss or damage. If you elect to arrange for someone else to deliver the goods to you, or will collect the goods from the sellers premises in the UK, you should make the appropriate election and contact the seller to make arrangements for the goods to be made available for collection. No collection of the Delivery Rate will be made by the seller in these circumstances. Full details of the charges to mainland Europe and Ireland are here.
6. EXCHANGE OR REFUND OF GOODS (UK ONLY)
Within 7 days following delivery of the goods you may choose to:-
6.1 Return the item(s) as exact in their original packaging at your own cost complete with any related accessories or booklets to: RETURNS, BAMBINO DIRECT, UNIT A, TRIDENT BUSINESS PARK, NEPTUNE WAY, LEEDS ROAD, HUDDERSFIELD, HD2 1UA. Please complete an online return form RMA. Once approved you will receive an e-mail notification with instructions detailing how to return. Without an approved RMA form, we cannot identify your return and it may be rejected and returned to you resulting in further delays in processing a refund/exchange. All returned items must be unused in all original packaging with all original booklets and accessories included and any tags/labels attached. The items(s) must be returned within 7 days of receipt of your approved RMA.
If an exchange is required no re-delivery can take place until we have received the returned goods from you. An extra delivery charge is also payable where applicable. It is your responsibility to obtain proof that the goods have been returned to us (royal mail signed for or parcel force is recommended which gives proof of date of postage and delivery tracking information). We reserve the right to refuse a refund if goods are not in an acceptable condition.
6.2 The following brands of furniture are non returnable: Boori, Babystyle, King Parrott, Bebe-Jou, Cosatto, Lollipop Lane, Izziwotnot, Kidsmill, Joseph or Tutti Bambini unless damaged which must be addressed in writing with photographic evidence. Refunds will not be supplied to faulty furniture but replacement parts provided as soon as possible.
6.3 Without prejudice no refund or exchange will be given for:- nappies, toiletries, self assembly furniture once fully or partially assembled, curtains and bedding once removed from packaging. We advise measurements are taken prior to ordering of any furniture or curtains.
7. RETURN OF DAMAGED GOODS
Any faulty items must be returned to us via obtaining a valid RMA number (which can be obtained by completing the online RMA form). If the item develops a fault within 7 days of delivery we will arrange for the collection, the item being returned must be well packed in the original packaging, (we strongly advise all original packaging is kept for upto six months). Items that develop a fault after 7 days are to be returned for repairs at customer expense. Items not securely packaged or boxed will under no circumstances be accepted. Once the goods have been inspected by the respective manufacturer we will arrange for the repair or replacement, we believe the decision lies with the manufacturer and will abide by the decision of the respective manufacturer. If the fault is found to be due to normal wear and tear, misuse or accidental damage you will be responsible for meeting the full cost of repair and the shipping charges. If upon inspection we are told by the respective manufacturer goods are not faulty or damaged we reserve the right to refuse a refund and/or charge a restocking fee of upto 40%. Please be aware all items for repair are sent to the respective manufacturer therefore the process can take upto 4 weeks. (NOTE: all items returned for any reason from outside the UK are returned at customers expense and risk)
8. REFUNDS
Under the distance selling regulations set by the OFT we will refund within 30 days any sum that has been paid by you or debited from your credit card for goods.
9 WARRANTY
9.1 Bambinodirect offers a 6 month warranty on all pushchairs excluding Bugaboo and Stokke Xplory whom offer a 2 year guarantee, Mountain Buggy & Phil & Teds & Silver Cross whom a 1 year warranty and Cosatto the 2 year dot to tot return to base warranty. The warranty commences from the day of delivery and we advise all original packaging is kept.
9.2 Bambinodirect strongly advise a full demonstration of all products. We cannot be held responsible for any damages as a result of incorrect assembly or mis-handling the product during assembly. Any replacement parts/components required as a result of this will be chargeable as advised by the respective supplier.
10. FREE GIFTS/PROMOTIONAL ITEMS
Free gifts and any promotional items offered are strictly subject to availability and form no part of the contact between the parties. We reserve the right to withdraw any gifts or offers without any prior notice.
11. DISPUTES
If there is a dispute we cannot settle, by direct negotiation this will be finally determined by the English courts and you agree to submit to the jurdisdiction of those courts.
12. DELAY OR FAILURE TO PERFORM
We shall not be liable to you if we are for any reason prevented or delayed in the performance of any of our obligations to you if this is due to any cause beyond our reasonable control including without limitation; an act of God, explosion, extreme weather conditions, flood, fire or accident, war or civil disturbance, strike, industrial action, stoppages of work, terrorism, a third party act or omission, failure of our supplier(s) in diffuiculty in obtaining materials and/or labour/deliveries, failure by you to give us a correct delivery address. We will inform you of any such unforeseen event and should this interruption continue beyond a period of one month you will be entitled to cancel the order and a refund will be made in accordance with clause 7 and 8 of these conditions.
13. GOVERNING LAW
These terms and the contract between us are governed by the English law. Nothing in tehse terms and conditions affect your statutory legal rights.
14. WEEE REGULATIONS
The Waste Electrical and Electronic Equipment (WEEE) Directive is now UK law. The legislation aims to make producers pay for the collection, treatment and recovery of waste electrical equipment. The regulations also mean that suppliers of equipment ie: high street stores and internet retailers must allow consumers to return their faulty equipment free of charge. The amount of WEEE we throw away is increasing by around 5% each year making it the fastest growing waste stream in the UK.
Recycling reduces the environmental and health risks associated with sending electrical goods to landfill.
Bambino Direct is obliged to offer our customers free take back of their WEEE ie: baby monitors to prevent it from going into a landfill site by disposing of it safely. Customers must return their WEEE item to us within 28 days. Under WEEE regulations all new electrical goods should now be marked with the crossed-out wheeled bin symbol.
